General Terms and Conditions
The General Terms and Conditions for the www.tadej-pogacar.com online shop have been prepared in accordance with the Slovenian Consumer Protection Act (ZVPot-UPB2), the Personal Data Protection Act (ZVOP-1), the Electronic Commerce Market Act (ZEPT), the Out-of-Court Settlement of Consumer Disputes Act (ZIsRPS), the Fiscal Validation of Receipts Act (ZDavPR), and following the recommendations of the Chamber of Commerce and Industry of Slovenia and international e-commerce codes.
The General Terms and Conditions cover the operation of the www.tadej-pogacar.com online shop and the rights and obligations of the buyer, and regulate the business relationship between the seller/online shop operator and the buyer.
The buyer is bound by the General Terms and Conditions valid at the time of submitting an online order. Upon placing an order, the buyer shall be reminded of these General Terms and Conditions. By submitting the order, the buyer accepts the General Terms and Conditions.

The operator/seller is company PROFIDTP d.o.o.
The user/buyer is the person using the website/online shop, i. e. the buyer in the online shop.
The online shop is an information system designed for presenting and selling products to users.
Availability of information
The operator undertakes to always provide the following information to the buyers:
company data (company name and registered office, registration number, VAT ID number, register)
contact data for quick and efficient communication (e-mail address and telephone)
essential characteristics of goods and services (including the after-sales services and warranties)
product availability (any product or service offered on the website should be deliverable within a reasonable period)
terms of delivery for products and terms of rendering for services (method, place and time of delivery)
all prices must be clearly and unambiguously specified, noting if the prices include taxes and the cost of delivery
method of payment and delivery
temporal validity of the offer
deadline for terminating the contract; including any costs of product return for the buyer
description of the complaint process, including the contact data for the contact person/customer service
The buyer can place an order:
as a registered user with a username and password (the user can also register during an online shopping session)
as a guest (registered user without a user account)
After registering in the online store, the visitor obtains a username equal to their e-mail address and sets a password of their choice. The username and the password unambiguously identify a user and link them to the data they enter. By registering, a visitor becomes a user and acquires the right to purchase.
Offer and prices
All prices are in euro and include the VAT. The price for a selected product or service is valid on the day of purchase, i.e. on the day when the buyer submits the order and completes the purchase in accordance with these General Terms and Conditions. The online shop retains the right to list a certain product on the website even if the product is not in stock and is no longer deliverable.
PROFIDTP d.o.o. is liable for the value-added tax.
Discounts, promo codes etc. do not add up.
We reserve the right to errors in product technical specifications. No claims regarding the product characteristics can be made based on the product images published on the website. The images are illustrative. We strive to provide only recent and accurate product images, but it cannot be ruled out that a product image is wrong or dated. In this case, the operator will enable the buyer to terminate the contract.
Ordering and purchase process
The online shop is open 24/7.
The buyer adds the items to the cart and follows the purchase steps.
The buyer browses the products and their variants on the website. To purchase a certain product, the buyer then clicks the ADD TO CART button.
Before submitting an order, the buyer can verify the order and the data entered are correct, including the quantities and the prices. If necessary, the buyer can correct the order.
To submit the order, the buyer then clicks the CONFIRM ORDER button. Confirmation of order is then delivered to the buyer by e-mail.
A sales contract between the seller and the buyer is concluded at the moment when the seller sends to the buyer the first e-mail with the order confirmation. From this moment on, all prices and other conditions are fixed both for the seller and for the buyer.
Methods of payment
The seller offers the following methods of payment:

payment by pro-forma invoice via transfer to the bank account of PROFIDTP d.o.o. (the bank account data is included in the order confirmation e-mail)
The seller ships the ordered items to the buyer together with an invoice including the cost breakdown.
The buyer is obliged to verify the data before submitting an order. No complaints with regard to the correctness of invoices issued will be accepted later.
Product return/termination of the contract
The buyer has the right to terminate the contract by notifying the seller in 14 days from receiving the items, no questions asked. The deadline shall be calculated from the next day after receiving the package.
The buyer shall notify the seller about the termination of the contract by sending an e-mail to the seller’s address: email@example.com

In the event of termination of the contract, the buyer shall return the received items to the seller’s address:

The buyer must return the original quantity of undamaged items in the original packaging unless the item was destroyed, or the quantity of items delivered was reduced without any fault on the buyer’s part.
The buyer may not use the items freely before terminating the contract. The buyer is allowed to inspect and test the items only to the extent necessary to determine their actual condition. The buyer shall be liable for any reduction in the value of goods caused by actions not strictly necessary to determine the nature, characteristics and performance of goods.
The only cost borne by the buyer in the event of termination of the contract is the cost of product return (charged according to the delivery service price list). The items shall be returned to the seller no later than 30 days after the notification of termination of the contract (purchase).
The buyer is not entitled to terminate a contract for items that were manufactured according to the buyer’s exact instructions, customized to their personal needs, are not suitable for return by their nature, or items that have already been used and are not suitable for resale due to reasons of hygiene.
Refunds of payments made, including the shipping costs, will be made as soon as possible, and no later than in 14 days after the notification of termination of the contract. The company shall refund the buyer using the payment method that was originally used by the buyer unless the buyer expressly demands a different payment method and incurs no additional costs.
The items are delivered with a warranty provided that this is specified on the warranty card or on the invoice. Claims can be made according to the warranty card, and the invoice must be attached thereto. The warranty period is specified on the warranty card or on the invoice.
Information about the warranty is also available on the item’s web page. If no information about the warranty is specified, it means that the item has no warranty or that the warranty terms are currently unknown. In that case, the buyer can request up-to-date information from the seller.
In the event of delivery of wrong products, the buyer shall return the delivered products and the seller will replace them with the correct products free of charge. In this case, the seller pays the shipping costs. The seller shall not cover the cost of return for the items subject to complaint if no faults are to be determined by the seller. The items shall be returned unused, undamaged and in the original packaging. They must be properly protected from transport damage, i.e. packaged in a hard box, if possible the same one the buyer received the products in.
Various discounts and promotions may be available on the www.tadej-pogacar.com website. The discounts are clearly specified next to the items. Discounts cannot be exchanged for cash payments. If you buy an item before a discount offer, you are not entitled to a possible discount on the item offered later.
Coupons, discounts and price reductions are not available for custom-made products.
We reserve the right to errors in the published discounts. The discounts are only valid inside the specified time period unless specified and published otherwise. The discounts apply to products in stock. During our discount offers, we reserve the right to display items that are no longer in stock or deliverable.
The operator uses suitable technical and organizational means to protect the transfer and storage of personal data, as well as the buyers’ payments. Payment card data is not stored on the operator’s server.
Personal data protection
By submitting an order under these General Terms and Condition, the buyer expressly consents that the seller may process their personal data – name and surname, address and ZIP code, e-mail address and telephone number – for the purpose of fulfilling the order under this contract, and protect it according to the Personal Data Protection Act. The seller will not transmit the buyer’s personal data to unauthorized third parties, except to contractual parties when this is necessary to fulfill the order. The buyer cannot withdraw consent for the processing of their personal data for the purpose of order fulfillment under these General Terms and Conditions.
The seller reserves the right to process the buyer’s personal data for its own purposes for statistical sampling, surveys, adjustment and segmentation of offer, market research, communicating promotions, news and offers, targeted advertising and sending of other advertisement materials (direct marketing). The seller will not conduct direct marketing if the buyer expressly prohibits it upon submitting the order, but otherwise, the seller is entitled to conduct direct marketing until the buyer withdraws consent or until the data no longer serves these purposes.
Storage of contracts
The contract concluded between the seller and the user (e-mail with the order confirmation) is stored permanently at the company PROFIDTP d.o.o. PE Trzin, Motnica 7A, 1236 Trzin, Slovenia.
Communication with the user
The operator will contact the user using remote communication means only if the user has not expressly objected to it, and according to the provisions of ZEKom-1. The advertising electronic messages will consist of the following elements:

various promotions and other marketing means will be clearly marked as such, terms and conditions for participation will be clearly specified

Notification and e-newsletter
By subscribing to our e-newsletter, the user agrees to be informed about the news and promotions on our website. The operator undertakes not to misuse the users’ e-mail addresses in any manner or to transmit them to third parties. The user can cancel the subscription anytime.
The operator shall make all reasonable efforts to make sure the data published on the website is up-to-date and correct. Nevertheless, the product properties, delivery periods or prices can change rapidly so that the operator is unable to correct the data on the website. In that case, the seller will notify the buyer about the changes and offer them the option of terminating the order or changing the ordered item.
The seller can terminate the contract only if an essential error is determined (Article 46 of the Slovenian Civil Code). An essential error includes errors in the essential characteristics of an item and all mistakes that are considered to be conclusive with regard to the trade customs or the intention of the parties, and which would deter the seller from concluding the contract if they were known to the seller beforehand. This includes obvious price errors.
Although the operator makes all efforts to display accurate product images, all images are illustrative. No claims regarding the product properties can be made based on the product images. The operator reserves the right to change these Terms and Conditions at any time and in any way, for any reason and with no prior notice.
Complaints and disputes
The operator complies with the applicable legislation on consumer protection. The operator makes all efforts to fulfil its duty of running an efficient complaint handling system and appoints a contact person for the buyer to contact by telephone or e-mail in the case of any issues. Please use the following e-mail address to file a complaint: firstname.lastname@example.org. The complaint handling process is confidential.
The operator shall attempt to resolve any dispute by common agreement.
Out-of-court resolution of consumer disputes
In line with the legal requirements, the operator recognises no providers for the out-of-court resolution of consumer disputes as competent for solving disputes initiated by the consumers according to the Out-of-Court Settlement of Consumer Disputes Act.
PROFITDP d.o.o., who operates the online store in the territory of the Republic of Slovenia as the provider of goods and services, publishes on its website a link to the European Online Dispute Resolution (ODR) platform.
This arrangement results from the Out-of-Court Settlement of Consumer Disputes Act and the Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC.
Our package delivery partner is POŠTA SLOVENIJE, but the operator reserves the right to select another delivery service in order to fulfill an order more efficiently.
The shipping cost depends on the order amount. Shipping is free for orders over 70.00 € in Slovenia and for orders over 140.00 € in the EU and other countries.
Any order submitted on the www.tadej-pogacar.com website will be processed the same day or the next working day. In the event that this is not possible due to any reason, the seller will notify the buyer. The package will be shipped/ready for pick-up in 3-5 working days after the order confirmation. The seller will notify the buyer if the delivery is not possible within that time, or if the order is dispatched early.
Returning damaged items
In case the package is physically damaged, something is missing or it shows signs of opening, the buyer must file a complaint with Pošta Slovenije or the service that made the delivery. To do this, take the package in the condition as delivered to the nearest post office or the delivery service that made the delivery, and fill in a complaint form. We will make sure to resolve the complaint together with Pošta Slovenije or the delivery service as soon as possible.
Changes to the Terms and Condition
The seller reserves the right to change these Terms and Conditions at any time as required by the regulatory provisions in force in this area, or if that is necessary in order to ensure legal, safe and good operation of the online store.
Changed Terms and Conditions are in force from the date of publication on this website.
